Litigation

Craig’s long experience as a trial lawyer and his ongoing interest in litigation matters gives him insight that can be useful to lawyers seeking advice about particular tribunals or specific trial-related issues, or to litigants who may be seeking referrals, second opinions or guidance on whether and how to pursue, prevent or defend litigation.

Often such consultations are inclusive and involve collaborative communication and cooperation with existing trial counsel, all with an eye toward improving the overall quality of service and opportunity for a successful outcome. On occasion, such consultations are more discreet and call for giving a different perspective to clients who have concerns about the current state or prospects of a particular case or situation.

By way of example, Craig often works with retained litigation counsel at other firms on strategy and tactics in complex litigation matters like those Craig has handled in the past. He has also been retained to evaluate pending litigation in advance of settlement negotiations or mediations so as to help guide the resolution process going forward. He even serves from time to time as “settlement counsel”, directly engaging opposing counsel in negotiations, especially where trial counsel is either unwilling or disinclined to do so. On occasion, he has been asked to review a pending case and evaluate the overall strategy, particular tactics or the performance of outside counsel.

Such engagements require varying degrees of discretion and tact, but Craig always approaches them with the same goal:  to maximize the ultimate client’s chances of success in the litigation process, and to get the dispute resolved as favorably, cost-effectively and efficiently as possible.

As such, Craig has consulted, and continues to consult, with other trial lawyers, business lawyers, in-house counsel, corporate executives and other non-lawyers on litigation strategy, tactics, evaluation, settlement and related issues.
